(Emsal : A\u0130UHK 02.10.2013 tarih ve 1593 say\u0131l\u0131 karar\u0131) Bu karar\u0131n da dayanak tutulmas\u0131, ihtilaf\u0131n \u00e7\u00f6z\u00fclmesinde yararl\u0131 olacakt\u0131r.<\/p>\n\n\n\n<p>MERKEZ\u0130 ISINMAYA GE\u00c7\u0130LEB\u0130L\u0130R<\/p>\n\n\n\n<p>&nbsp;KMK\u2019n\u0131n 42. maddesiyle kat maliklerinden birisinin iste\u011fi \u00fczerine, \u0131s\u0131tma sistemi de\u011fi\u015fikli\u011finin yap\u0131labilmesi i\u00e7in kat maliklerinin say\u0131 ve arsa pay\u0131 \u00e7o\u011funlu\u011funca karar al\u0131nmas\u0131 yeterli g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Bu haliyle, ferdi \u0131s\u0131tma sistemleri, merkezi sisteme \u00e7evrilmek suretiyle de okurlar\u0131m\u0131z\u0131n sorununa \u00e7\u00f6z\u00fcm bulunabilir.\u201d \u00d6zetlersek: Bireysel \u0131s\u0131tma sistemi olan apartmanlarda \u0131s\u0131nma sorunu ya\u015fayan okurlar\u0131m, avukat \u00c7ankaya\u2019n\u0131n belirtti\u011fi gibi \u00f6ncelikle \u201ckom\u015fuluk hukuku\u201d i\u00e7inde \u00e7\u00f6z\u00fcm aramal\u0131.
